Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") are a binding agreement between you and EngineX ("engineX", "we", "us", or "our"), the operator of the engineX platform and website. By creating an account, clicking to accept, or otherwise using engineX, you agree to be bound by these Terms and by our Privacy Policy.

If you do not agree to these Terms, you must not access or use the service. If you use engineX on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to it.

2. Description of the Service

engineX is an AI-powered application builder. You describe what you want in natural language, and AI agents generate application code, which runs in an in-browser development environment (powered by WebContainer technology) with a built-in code editor, live preview, and the ability to export or download your code. Your projects and chat history are saved to your account.

The service evolves continuously. We may add, change, suspend, or remove features at any time. Features described as "Coming Soon" or similar are not commitments and may change or never launch.

3. Eligibility and Accounts

You must be at least 13 years old (or the age of digital consent in your jurisdiction, if higher) to use engineX. You can create an account by signing in with Google or with an email address and password. You agree to provide accurate information and keep it up to date.

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately at team.enginex@gmail.com if you suspect unauthorized use of your account. We are not liable for losses caused by unauthorized use resulting from your failure to protect your credentials.

4. Acceptable Use

You agree not to use engineX to:

  • violate any applicable law or regulation, or infringe the rights of others;
  • generate, host, or distribute malicious code, including malware, phishing pages, or code designed to harm, deceive, or gain unauthorized access to systems or data;
  • circumvent or abuse usage limits, credits, or message quotas, including by creating multiple free accounts;
  • scrape, crawl, or access the service through automated means other than interfaces we provide;
  • reverse engineer, decompile, or attempt to extract the source code or underlying models of the platform;
  • resell, sublicense, or white-label the service itself; or
  • interfere with or disrupt the integrity or performance of the service or its users.

We may investigate violations and suspend or terminate accounts that breach this section.

5. Your Content and Generated Code

You retain ownership of the prompts, files, and other content you submit to engineX, and, as between you and us, you own the application code the service generates for you. You are free to export, modify, and commercially use your generated code.

You grant us a limited, worldwide, non-exclusive license to host, store, process, and display your content solely as needed to operate, maintain, and improve the service. You represent that you have all rights necessary to submit your content and that it does not violate these Terms or any law.

6. engineX Intellectual Property

The engineX platform — including its software, agent and prompt systems, design, branding, logos, and website content — is owned by EngineX or its licensors and is protected by intellectual property laws. Except for the rights expressly granted in these Terms, no rights in the platform are granted to you.

If you send us feedback or suggestions, we may use them without restriction or obligation to you.

7. AI-Generated Output Disclaimer

Code and other output on engineX is produced by artificial intelligence, including third-party AI models. Output may be inaccurate, incomplete, insecure, non-functional, or similar to output generated for other users. It is provided "as is".

You are solely responsible for reviewing, testing, and validating any generated code before relying on it or deploying it to production. Output is not professional, legal, security, or other advice.

8. Plans, Billing, and Trials

engineX is currently free to use during the early access period. Paid plans, when available, are described on our Pricing page and will be billed on a recurring monthly or annual basis through our payment processor.

  • Paid tiers include a 14-day free trial; no charge applies until the trial ends.
  • Usage quotas (such as credits, AI messages, and active projects) reset each billing cycle and do not roll over.
  • You may cancel at any time; cancellation takes effect at the end of the current billing cycle. Downgrading may restrict access to projects that exceed your new plan's limits.
  • Except where required by law, fees are non-refundable. We may change prices with advance notice; changes apply from your next billing cycle.

9. Third-Party Services

The service is built on third-party services, including Google Gemini (AI generation), Firebase and Google Cloud (authentication, hosting, and data storage), StackBlitz WebContainer (the in-browser runtime), GitHub (integrations), and a payment processor for paid plans. Your use of those services through engineX may be subject to their own terms and privacy policies.

We are not responsible for the availability, acts, or omissions of third-party services, or for third-party websites linked from the service.

10. Termination and Suspension

You may stop using engineX or delete your account at any time. We may suspend or terminate your access if you breach these Terms, abuse the service, or where required by law, and we may do so without prior notice where reasonably necessary.

Upon termination, your right to use the service ends. We encourage you to export your code and project data before your account is closed. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) survive.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT GENERATED CODE WILL BE ACCURATE, SECURE, OR FIT FOR ANY PURPOSE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EngineX AND ITS OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR DAMAGES ARISING FROM YOUR USE OR DEPLOYMENT OF GENERATED CODE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR ONE HUNDRED US DOLLARS (USD $100).

13. Changes to These Terms

We may update these Terms from time to time. If a change is material, we will provide notice through the service or by email before it takes effect. The "Last updated" date above reflects the current version. Your continued use of engineX after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the Republic of Ghana, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the service will be subject to the exclusive jurisdiction of the courts of Ghana.
